When routine AI use becomes a legal issue
A loan officer asks AI whether a demand crossed the line. A credit memorandum quietly turns "discussed a sale" into "agreed to sell." A borrower uses AI to plan an asset transfer before default. By the time counsel gets the call, the evidence may already exist.
Through commercial and agricultural lending scenarios, the seminar examines how prompts, uploaded documents, generated drafts and abandoned ideas can become evidence. It addresses when to involve counsel, how to approach preservation and how an opposing party's AI records may become relevant to a dispute.
The program also considers broader legal and regulatory concerns surrounding AI-assisted lending, customer communications, confidential information, vendor tools, employment decisions and AI-enabled fraud.
Program topics
- Recognizing when an ordinary AI request creates legal exposure or potential litigation evidence.
- Distinguishing routine business records from potentially privileged or protected work.
- Identifying preservation issues and opportunities to seek an opposing party's AI records.
- Evaluating AI-related risks across lending, customer service, data handling and other bank functions.
- Establishing practical triggers for counsel review, human verification and incident escalation.
