Start with the decision the business needs to make

The immediate question may be whether to respond to a demand, file a claim, seek urgent court relief or pursue a negotiated resolution. We begin by examining the underlying agreement, the chronology, the evidence and the client’s objectives.

That assessment also needs to consider what a judgment or settlement would accomplish. The strength of a claim, the ability to collect, the cost of discovery and the effect on ongoing operations all bear on the strategy.

Ownership and internal business conflicts

Disagreements among owners can involve access to records, management decisions, distributions, use of company property or an owner’s exit. We assess the governing documents and the conduct at issue, then consider the available contractual and legal remedies.

Financial disputes and distressed businesses

Commercial litigation sometimes overlaps with an unpaid loan, a failing counterparty or a bankruptcy filing. Our banking and creditors’ rights and bankruptcy litigation practices help address those related issues.

Farm, agribusiness & agricultural trust disputes

Agricultural litigation calls for an understanding of the business as well as the governing documents. Matthew Bialick’s experience includes farm collateral and grain-fronting appeals, distressed agricultural businesses and current litigation involving an agricultural trust. The practice considers disputes involving farm contracts, ownership, financial obligations and agricultural assets.

Disputes involving public statements
